Our Fees
Claimant or paying party complete service
All work undertaken on a CFA, our fees are paid directly by the defendant in addition
to (as opposed to deducted from) the Solicitor’s costs.
The aim is for our claimant service to be at worst revenue neutral for the instructing Solicitor, so we will never charge more than we recover from the defendant as an additional amount over and above the Solicitor's fees
In any event, we cap our fees at band 2 grade D rates for fast track work and band
2 grade C rates for multi- track work. There are certain circumstances (such as
the location of the Claimant or the complexity of the case) where a higher rate
can be claimed from the paying party. In those circumstances we claim the higher
rate, but charge our standard rate, giving the benefit of the additional recoveries
to the instructing solicitor.
In addition, unlike many draftsmen, where the costs of drawing a bill of costs and
dealing with the assessment process attract a success fee under the instructing
solicitors CFA, we do not claim the benefit of that success fee, but pass it on
to our instructing solicitor.
Both of these practices have been approved by the Court of Appeal.
Defendant or paying party complete service
As paying party work is undertaken from the onerous starting point that the receiving
party is entitled to the costs of the assessment, our CFA for such work entitles
us to be paid a fixed fee in any event being;
- Matter settles before preparation of points of dispute; £150 fast track, £200 multi
track.
- Matter settles after preparation of points in dispute £300 fast track, £400 multi
track.
Subject to the fixed minimum fee all work is undertaken under a CFA as above and
we recover from the opponent if successful, a recoverable success fee is applied
in this type of work.
Modular work
All modular work is undertaken on an hourly rate as set out above. In respect of
commercial bills we will charge an hourly rate up to band 1 grade C guideline rate,
dependant on the level of fee earner required to undertake the work, we are happy
to agree a cap on our fees at a percentage of profit costs claimed for preparation
of bills of costs.
We will claim in the bill all time spent at the recoverable hourly rate regardless of whether or not that is more than the hourly rates charged or the capped fee agreed.
